Work Performance is Dictated by People’s Biology Rather than Effort or Rewards

KUALA LUMPUR, Malaysia  /PRNewswire/ — Workers could be wasting their efforts and employers failing to encourage improved performance because of the inherent limits of the human brain, according to new neuroscience research sponsored by the Chartered Institute of Management Accountants (CIMA).

Academics from the Erasmus University’s Rotterdam School of Management and the University of Ljubljana inSlovenia measured and analysed participants’ brain activity, using functional magnetic resonance imaging (fMRI), while they performed a series of computer-based tasks, measuring their ability to assess information under different time pressures and types of distractions. The researchers distinguished between situations in which managers received a monetary reward for speed and accuracy and a different scenario where managers experienced social pressure to perform well.

The study discovered that while monetary incentives and social pressure result in people working harder, their performance seemed not to improve for work that requires vigilance and attention.

Prof. Dr Frank Hartmann, Professor of Management Accounting and Management Control at the Rotterdam School of Management, Erasmus University, said: “If basic biology limits our ability to improve at certain types of work, we need to think more imaginatively about the way we measure and reward work performance. It may be much more task specific than we are currently inclined to think. Businesses need to recognise where performance limits may lie and avoid frustrating employees when results do not reflect best efforts. Organisations should take care that performance assessments accurately capture the efforts of workers, both to measure whether targets and incentives are effective and to ensure that individuals are rewarded fairly.”

Dr Ian Selby, Director of Research and Development at CIMA, said: “This is a fascinating study, and it indicates that many companies are causing pointless stress to employees, or are wasting money on ineffectual bonus schemes. Modern companies have a large set of incentives available to them, yet many keep reaching for two in particular: exerting pressure from above, or incentivising through bonuses. In many cases these tactics work, but as this research indicates, sometimes these are simply the wrong tools for the job. The solution is for organisations to innovate. They must look at new ways to manage and incentivise people, using the same mindset as they would for product development.”

Jury Finds in Follow-On Case that GENBAND Does Not Infringe Metaswitch’s Patents

PLANO, Texas /PRNewswire/ — In January, a jury returned a verdict finding widespread infringement by Metaswitch Networks Ltd and Metaswitch Networks Corp. of seven GENBAND patents. Among the Metaswitch products found to infringe in that case were: Metaswitch’s Session Border Controllers; Metaswitch’s Integrated Softswitches; Metaswitch’s Call Feature Servers; Metaswitch’s Universal Media Gateways; and Metaswitch’s MTAS platform with both Accession (supporting Call Jump) and Commportal software (supporting Click to Dial). Today, a jury in the United States District Court for the Eastern District of Texas returned a verdict in the follow-on case brought by Metaswitch. The jury found that GENBAND does not infringe any of Metaswitch’s six asserted patents and found that three of them are invalid. In doing so, the jury rejected Metaswitch’s claim for over $59 million in damages.

Argentina Settles With 115 Individual Bondholders, Holding $155 Million In Defaulted Bonds

NEW YORK /PRNewswire/ — Daniel A. Pollack, Special Master presiding over settlement negotiations between the Republic of Argentina and its Bondholders, issued the following statement this morning:

“I am very pleased to report the settlement of claims of 115 individual bondholders, holding $155 million of defaulted bonds in cases pending in the Southern District of New York before Judge Thomas P. Griesa.  These settlements fall squarely within the terms of the Propuesta of February 5, published  by the Republic of Argentina.  The parties anticipate that most of these bondholders, all of whom have both money judgments and injunctions, will opt to receive 70% of their claims rather than 150% of the principal of their bonds, both of which are options available to them under the Propuesta of February 5. However, a few of the bondholders are considering selecting the option of 150% of principal.  As with all such settlements, these are subject to the lifting of the Lock Law and the Sovereign Payment Law by the Argentine Congress and the lifting of the Injunctions by Judge Griesa.  In that regard, meaningful  progress has already been made. The lower chamber of the Argentine Congress this week approved a bill lifting those restrictive laws, and that bill now goes to the Argentine Senate for consideration. Additionally, Judge Griesa, on March 2, vacated the Injunctions, and that issue now goes to the Court of Appeals for the Second Circuit. This group of 115 individual bondholders had appealed the vacating of the Injunctions by Judge Griesa, but have now withdrawn their appeals with prejudice. The law firm of Duane Morris, which represented these individual bondholders, played a constructive role in organizing them and in the negotiations with the Republic before me as Special Master. It is my belief that these settlements with numerous individual bondholders demonstrate that, where the parties wish to reach accord, it can be done, irrespective of the size of the holdings of the bondholder.  These settlements are not with large, multi-billion dollar hedge funds, but with regular, individual investors who saw the opportunity, for the first time in many years, to settle their claims with Argentina and seized that opportunity in good-faith negotiations.  I will have no further comment on these settlements at this time.”
